Terms of Service

1. Eligibility

NFASync is available to individuals, gun trust trustees, and federally licensed firearms dealers (FFLs/SOTs) who are legally eligible to possess NFA items under federal and state law. By registering, you represent and warrant that:

• You are at least 18 years of age
• You are a legal resident of the United States
• You are not a "prohibited person" as defined under 18 U.S.C. § 922(g), including but not limited to individuals who have been convicted of a felony, are a fugitive from justice, are an unlawful user of or addicted to a controlled substance, have been adjudicated as mentally defective or committed to a mental institution, are an illegal or unlawful alien, have been dishonorably discharged from the military, have renounced U.S. citizenship, are subject to a qualifying domestic restraining order, or have been convicted of a misdemeanor crime of domestic violence
• You are not otherwise prohibited from possessing firearms or NFA items under any applicable federal, state, or local law
• All biographical information, fingerprint data, and trust information you provide is accurate and truthful
• You are authorized to submit the fingerprint data and biographical information you upload to NFASync

NFASync does not perform background checks, verify prohibited person status, or determine your legal eligibility to possess firearms or NFA items. It is solely your responsibility to know and comply with all applicable laws. If a prohibited person uses NFASync, that individual bears full legal responsibility. NFASync is not liable for any use of the platform by a person who is legally prohibited from possessing firearms or NFA items.

We reserve the right to verify your eligibility at any time. If you are found to be ineligible, your account may be terminated immediately without refund.

2. Account Responsibilities

• You are solely responsible for maintaining the confidentiality of your account credentials
• You are solely responsible for all activity that occurs under your account
• You must provide accurate, current, and complete information during registration and keep it updated
• You are solely responsible for the accuracy of all biographical information, fingerprint data, and trust details you enter or upload
• You must notify us immediately of any unauthorized use of your account
• You may not share, transfer, or allow others to access your account
• You may not upload fingerprint data belonging to another person without their explicit consent and legal authorization

3. Purchases, Billing & Refund Policy

Products & Pricing

NFASync offers subscription plans and one-time purchase products including EFT file generation, gun trust creation (through our partner National Gun Trusts), RPQ generation, eForm auto-fill, and NFA item management. Current pricing is available on our pricing page. We reserve the right to change pricing at any time.

No Refund Policy

All payments are final and non-refundable. TenScan LLC does not provide refunds for any reason, including but not limited to: dissatisfaction with the service, EFT files that do not result in an approved eForm, account termination by TenScan, or service interruptions. By purchasing, you acknowledge and accept this no-refund policy.

5. Fingerprint Data & Sensitive Information

By uploading a scanned FD-258 fingerprint card, you acknowledge and agree that:

• The fingerprint card you upload belongs to you or you have explicit written authorization from the individual whose prints appear on the card
• You are responsible for the quality and legibility of the scanned fingerprint card
• NFASync processes your fingerprint scan to generate an EFT file but does not verify your identity through biometric matching
• Your fingerprint data, biographical information, and generated EFT files are stored securely in accordance with our Privacy Policy
• You may delete your fingerprint data and EFT files from your account at any time

6. Termination & Cancellation by TenScan

TenScan LLC reserves the right to suspend, restrict, or permanently terminate your account at any time, for any reason, at our sole and absolute discretion, with or without notice and without refund. Reasons for termination include but are not limited to:

• Violation of these Terms of Service
• Uploading fraudulent, falsified, or unauthorized fingerprint data
• Providing false biographical or identity information
• Suspected fraud, abuse, or misuse of the platform
• Activity that we believe may harm TenScan, other users, or government agencies
• Using NFASync to facilitate any illegal activity
• Failure to pay service fees
• Any other reason at our sole discretion

Upon termination, your access to NFASync ceases immediately. You are not entitled to any refund of fees paid. All provisions of these Terms that by their nature should survive termination shall survive, including limitation of liability, indemnification, and dispute resolution.

7. Acceptable Use

You agree not to:

• Use NFASync for any unlawful purpose or in violation of any applicable federal, state, or local laws
• Upload fingerprint data belonging to another person without their explicit consent and legal authorization
• Submit falsified, altered, or fraudulent fingerprint cards or biographical information
• Use NFASync to generate EFT files or eForms for any person who is prohibited from possessing NFA items
• Scrape, crawl, or use automated tools to extract data from our platform
• Attempt to gain unauthorized access to our systems or other user accounts
• Resell, redistribute, sublicense, or publicly display any data or files obtained through NFASync
• Interfere with or disrupt the integrity, performance, or security of our services
• Misrepresent your identity, eligibility, or authorization
• Use NFASync in any manner that violates ATF regulations, NFA laws, or federal/state firearms laws

8. Third-Party Services

National Gun Trusts

NFASync partners with National Gun Trusts for gun trust creation. When you use this feature, your information is shared with National Gun Trusts solely for the purpose of creating your trust document. National Gun Trusts' own terms of service and privacy policy apply to their services. TenScan LLC is not responsible for the legal validity, enforceability, or sufficiency of any trust document created through this partnership.

ATF eForms

NFASync provides tools to assist with completing ATF eForms but does not submit forms on your behalf. You are solely responsible for reviewing, verifying, and submitting your eForms directly through the ATF eForms website. TenScan LLC is not affiliated with, endorsed by, or partnered with the ATF or any government agency.

9. Intellectual Property

All content, features, functionality, software, design, text, graphics, logos, and trade names associated with NFASync are the exclusive property of TenScan LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, reverse engineer, distribute, or create derivative works from any part of our platform without prior written consent from TenScan LLC.

EFT files generated by NFASync are provided for your personal use in ATF eForm submissions. You retain ownership of your uploaded fingerprint scans, biographical data, and documents stored in your account.

11. Disclaimer of Warranties

NFASync IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TENSCAN LLC SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; EFT FILES WILL BE ACCEPTED BY THE ATF OR FBI; EFT FILES GENERATED FROM LOW-QUALITY, SMUDGED, OR POORLY SCANNED FINGERPRINT CARDS WILL BE USABLE OR ACCEPTED; UPLOADED FINGERPRINT SCANS OR PDF FILES WILL PRODUCE COMPLIANT OUTPUT IF THE SOURCE MATERIAL IS DEFECTIVE; EFORM AUTO-FILL DATA WILL BE ACCURATE OR COMPLETE; PASSPORT PHOTOS YOU UPLOAD WILL MEET ATF REQUIREMENTS; GUN TRUSTS WILL BE LEGALLY VALID IN YOUR JURISDICTION; RESULTS OBTAINED FROM THE SERVICE WILL BE RELIABLE; OR ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

12. Indemnification

You agree to indemnify, defend, and hold harmless TenScan LLC DBA NFASync, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: your use of NFASync, your violation of these Terms, your violation of any third-party rights, any EFT files or eForms submitted using NFASync data, any regulatory actions related to your NFA submissions, uploading unauthorized fingerprint data, or your negligence or willful misconduct.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any disputes arising from these Terms or your use of NFASync shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Michigan.

You waive any right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any class or representative proceeding.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TenScan LLC regarding your use of NFASync and supersede all prior agreements, communications, and understandings, whether written or oral.

16. Changes to These Terms

TenScan LLC may modify these Terms at any time at its sole discretion. Changes are effective immediately upon posting to this page. We may, but are not obligated to, notify you of material changes. Your continued use of NFASync after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
